Bhopal: Public services within prescribed time limits have been provided to about 34 lakh people in Madhya Pradesh during last seven and half months under M.P. Public Service Delivery Guarantee Act enacted in August last year. The efficacy of this legislation can be gauged from the fact that Bihar government studied and replicated it in Bihar. It is also significant that corruption watchdog Transparency International India has lauded the initiative of Madhya Pradesh government.
While releasing its guidelines about Citizens’ Charters recently the Transparency International referred to this legislation and had a word of praise for it. It also referred to the similar legislation. But, but it has been patterned on the legislation of Madhya Pradesh.
The website of the Transparency International says that realizing that the provisions of Citizens’ Charters were not legally binding and there is a need for the timely delivery of public services, the Madhya Pradesh government has now enacted its Public Services Guarantee Act as an effective instrument to improve governance. This Act guarantees the delivery of services as a first of its kind initiative in the country. The Act provides for a penalty of Rs 250 per day and a maximum amount of Rs 5,000 on the concerning officer for delay and excuses. The amount of fine so realized from the erring official would be given to the affected applicant. To ensure its implementation, a separate public service management department has been created with necessary resources and staff.
Subsequently, the state government has amended the legislation to penalize the first appellate office in case he is found guilty of deliberately delaying the appeal. The nine departments whose services have been covered under the Act include Energy, Labour, Public Health Engineering, Revenue, Urban Development and Administration, General Administration, Social Justice, Scheduled Castes and Scheduled Tribes Development, Food, Civil Supplies and Consumer Protection departments.
